All States and Territories now have or are about to have operative Security of Payment legislation. Up until now, NT, Qld, NSW, Vic and WA had enacted this legislation. Tasmania’s Security of Payment Act commenced on 17 December 2009. This is broadly similar to the NSW Legislation but more detailed analysis will follow.

The ACT has also recently passed Security of Payment legislation to join other states and it comes into operation on 1 July 2010. It is again broadly similar to the NSW legislation – more detailed analysis will follow.

SA has also just passed its Security of Payment Act which is anticipated to come into operation during 2010 (at a date yet to be fixed) This Act is yet again similar to the NSW Security of Payment Act, but more detailed analysis will follow.
